A Magistrate court in Abuja has summoned Precious Chikwendu, the estranged wife of former minister of Aviation, Femi Fani-Kayode, her sister Prisca Chikwendu and four others over alleged forgery and conspiring to malign the person of her former husband.
The order of summons was granted by the presiding magistrate, his worship, Elizabeth Woni during the arraignment of one of the accused persons, Emmanuel Anakan by the Federal Capital Territory Police Command on allegations of false first information.
In the course of proceedings, the prosecution counsel, Barr. John Ijagbemi revealed that other five persons at large in collaboration with the arraigned person, Emmanuel Anakan conspired and swore false affidavits, presented as genuine information to some national dailies, with the sole intent to destroy the reputation of the former Aviation Minister.
Counsel told the court that other five accused persons who are currently at large have continued to be evasive during police investigation, as he asked the court to summon them to appear before it and answer to the matter brought before it.
Reacting, defence counsel Emmanuel Okewu called the attention of the court to a fundamental human rights enforcement suit related to the case at hand, before the Federal High Court.
In his response, his Worship reminded counsel that the matter before the instant court was a matter of first information and that the court has the right of summons for parties joined in the matter to answer to allegations brought against them.
The court therefore ruled that the accused persons who are currently at large should be summoned to appear before it and answer to the issues brought against them.
Meanwhile, the defence counsel, Barr. Emmanuel Okewu made an oral bail application, for his client who has been in detention since August 28th, but the prosecution counsel vehemently objected to it.
However, the presiding magistrate granted the bail application to the sum of 1.5 million naira and two sureties in like sum, and that the sureties must be rest in Abuja, be reasonable and show prove of a legitimate occupation.
The matter was adjourned to November 5, 2021 for hearing.
The prosecution counsel, Barrister John Ijagbemi of the legal department of the FCT Command of the Nigeria Police Force, addressed men of the press after the day’s business.
“The major business of today is arraignment. We brought seven defendants before the honourable court; the first among them is Emmanuel Anakan, the second is Precious Chikwendu, then her sister Prisca Chikwendu and three others. And they were all alleged to have conspired among themselves to commit offences of forgery, using as genuine forged documents and not only that, they conspired to defame the character of Chief Femi Fani-Kayode.
“Part of the allegations is also that they went and fabricated and falsified affidavit of fact against the chief, implicating him of harassing and intimidating his domestic staff.
“Even though the six of them were not in court, the court has graciously on the application of the prosecution issued summons to invite them to the court because they have been evasive during police investigations. We hope that by the next adjourned date, they will honour the summons issued on them by the hounourable court.”
