DSS Slams Five-count Charge against Two of Igboho’s Followers

-     Alleges possession firearms and ammunitions

-     Accuses female defendant of cybercrime

The Department of State Service, (DSS) has instituted a five-count charge case before an Abuja Division of the Federal High Court, against Jamiu Oyetunji (M) and Amudat Babatunde (F), both members of the Sunday Adeyemo (Sunday Igboho) led agitation for Yoruba Nation.

According to the case file numbered FHC/ABJ/CR/305/0021 sighted by our reporter, the process was instituted on August 31, 2021 at the Abuja Division of the Federal High Court and signed by S.M. Bello Esq. and M.I Bennett Esq. on behalf of the DSS.

Count one of the charges centres on allegations of conspiration to commit acts of terrorism and possession of fire arms.

“That you Jamiu Noah OYETUNJI, Amudat Habibat BABATUNDE, adults with others still at large, on or about 1st day of July, 2021, at the residence of one Sunday Adeniyi ADEYEMO(aka Igboho), located at Soka area of Ibadan, Oyo State within the jurisdiction of this Hounourable Court did conspire to commit acts of terrorism, to wits possession of prohibited fire arms: contrary to Section 17 of Terrorism (Prevention) (Amendment) Act, 2013 and punishable under the same Section of the Act” the count read.

The second count charge was based on possession of firearms which were listed in the instituted court process.

“That you Jamiu Noah OYETUNJI, Amudat Habibabt BABATUNDE, adults with others still at large, on about the 1st day of July, 2021, at the residence of Sunday Adeniyi ADEYEMO, (aka Sunday IGBOHO) located at Soka area of Ibadan, Oyo State within the jurisdiction of this Honourble Court did had in your possession, without lawful authority, the under listed prohibited fire arms: Five (5) AK 47 rifles with serial numbers 04956, 213740, 8673, 945999 and 6139 respectively; Two (2) AK 47 rifles which serial numbers could not be identified; Two (2) pump action rifle with serial with serial numbers 8836 and 9398 respectively; One (1) pump action which serial number could not be identified; and One (1) stun gun.

“Contrary to Section 1(3)©(v) of the Terrorism Prevention Act CAP 10, 2011 and punishable under Section 1(2) of the Terrorism Prevention (Amendment) act 2013”, read the count.

Count three which is similar to the first two counts beyond possession firearms, alleges that the defendants of possessing live ammunitions.

“That you Jamiu Noah OYETUNJI, Amudat Habibat BABATUNDE, adult with others still at large, on or about the 1st day of July, 2021, at the residence of Sunday Adeniyi ADEYEMO (aka Sunday IGBOHO) located at Soka area of Ibadan, Oyo State within the jurisdiction of this Honourable Court did had in your possession, without lawful authority one thousand, two hundred and ninety five (1,295) live rounds of 7.62mm ammunitions and two hundred and twenty one (221) live rounds of 5.56mm ammunitions Contrary to Section 1(3)©(v) of the Terrorism Prevention Act CAP 10, 2011 and punishable under Section 1(2) of the Terrorism Prevention (Amendment) act 2013.”

The Fourth count alleges that the defendants were involved in terrorism activities contrary to relevant laws of the Federal Republic of Nigeria.

And the last count read, “That you Amudat Habibat BABATUNDE (f) adult of Okeare area of Ibadan, Oyo State did used your Facebook account as a platform to promote terrorist activities contrary to Section 18(1 & 2) of the Cybercrimes Prohibition Prevention) Act, 2015.”

At the time of filing this report, the case was yet to be assigned a date for hearing.
